One of the many good things to come out of the 2002 Brownfields Amendment was a new Superfund liability protection known as a bona fide prospective purchaser (BFPP). This liability protection allowed individuals to acquire property knowing, or having reason to know, of contamination and not be held liable for the contamination. However, buyers need to be smart about their investment because the upfront due diligence necessary to establish the BFPP protection can be a lot more simpler than the continuing obligations BFPPs have during their ownership to maintain their BFPP defense.
