The owner rejected a $19.5-million fix designed by John A. Martin Associates, calling the building beyond repair. Tutor Perini blames the design for the Harmon's troubles and says the building could be shored up.

But the building has since undergone four rounds of destructive testing, making it no longer easily fixable since "being compromised by the removal of concrete," said John A. Martin in a statement. Tutor-Perini disagrees that the building is a safety risk.

A jury trial is set for April 28 on the Tutor Perini-MGM suits, although the date has changed several times.
