As directed by the 2005 SAFETEA-LU law, the Dept. of Transportation has issued a final rule revising requirements for road and transit projects that may affect parks, wildlife refuges and historic sites. The rule, effective April 11, deals with the 1996 DOT Act’s Section 4(f), which bars projects from affecting such sites unless there is no feasible alternative. The new rule has language to help determine “de minimis” effects on 4(f) sites.
